The Zoning Board of Appeals of the Village of Great Neck shall hear the application of Daniel Shaliehsaboo, owner, represented by Stephen Schlesinger, attorney, for the premises at 113 Steamboat Road in Great Neck. The applicants are seeking the following variance(s) from the Village Zoning Code in connection with their application to re-instate the nonconforming multi-family use (not otherwise permitted in a Residential C Zone under §575-77): 1. §575-171 Nonconforming Buildings and Nonconforming Uses† The following provisions shall apply to all buildings and uses existing on the effective date of this chapter which do not conform to the requirements set forth in this chapter and to all buildings and uses that become nonconforming by reason of any subsequent amendment to this chapter. A. Nonconforming buildings and nonconforming uses. Any nonconforming use of buildings or open land existing at the time of adoption of the original ordinance on December 3, 1930, may be continued indefinitely but shall not be: (4) Reestablished if such use has been discontinued for any reason for a period of one year or more or has been changed to or replaced by a conforming use. Intent to resume a nonconforming use shall not confer the right to do so. 2. §575-171 Nonconforming Buildings and Nonconforming Uses The following provisions shall apply to all buildings and uses existing on the effective date of this chapter which do not conform to the requirements set forth in this chapter and to all buildings and uses that become nonconforming by reason of any subsequent amendment to this chapter. B. Rebuilding of damaged structures; permit required. (4)†Failure to apply for a building permit within six months from the date upon which the damage occurs shall be deemed an abandonment of such structure. The premises are also known as Section 1, Block 198, Lot(s) 28 on the Nassau County Land and Tax Map, and are located in the Residence Zoning C District. A copy of the application materials is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
