NOTICE OF PUBLIC HEARING 17 Hartley Road (Section 1 /Block 115 /Lot(s) 54)PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, November 3, 2022 at 7:30PM at Saddle Rock Village Hall, 18 Masefield Way, Great Neck, NY 11023, to hear the application of Hertzel Sure, owner, represented by Paul Bloom, attorney, for the premises at 17 Hartley Road in Great Neck. The applicant is seeking the following variance(s) from the Village Zoning Codes:1. ßSection 575-54 Lot CoverageLot coverage on a residential lot in the Residence B District shall not exceed the following thresholds:B. Rear yard coverage: 40%.The proposed maximum rear yard lot coverage is 324 SF, whereby the maximum allowed is 288 SF. A variance of 36 SF is required. 2. ßSection 575-56 Front YardsAll lots shall have at least one front yard. A corner lot shall have a front yard on each public street on which the lot abuts. All front yards shall have a minimum depth equal to the greater of 25 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet. In no event, however, shall a front yard be required to have a depth which is greater than 35 feet.The proposed average front yard is 21.67 feet, whereby the minimum required is 25.03 feet. A variance of 3.36 feet is required. 3. ßSection 575-58 Rear YardThere shall be a rear yard, the depth of which shall be 25 feet plus 1/4 of the depth of the lot in excess of 100 feet.The proposed rear yard is 11.96 feet, whereby the minimum required is 26 feet. A variance of 14.04 feet is required. 4. ßSection 575-52 Building Area and Floor Area RatioA. For single-family dwelling use, the building area shall not exceed 30% of the lot area and, subject to any modifications required by ß 575-167 of this chapter, the floor area ratio shall not exceed the limits hereinafter set forth.(2) On corner lots: 0.50 of the first 6,000 square feet of lot area; and 0.15 of the lot area in excess of the first 6,000 square feet.The proposed floor area is 2,9549.74 SF, whereby the maximum allowed is 2,786.40 SF. A variance of 163.34 SF is required. 5. ßSection 575-170.2 Outdoor CompressorsB. Location. Outdoor compressors used in connection with air-conditioning systems shall belocated in the rear yard immediately adjacent to the rear wall of the residence and at least 20 feet from any property line.A compressor must be a minimum of 20 feet from the property line, whereby 17 feet-4 inches is proposed. A variance of 2 feet-8 inches is required. 6. ßSection 391-2 Prohibited Noises EnumeratedThe following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this article, but any enumeration herein shall not be deemed to be exclusive:N. The operation of any machinery, equipment, pump, fan, exhaust fan, attic fan, air-conditioning apparatus or similar mechanical device in such manner as to create a sound which exceeds the following limits:(1) At a residential property line between 9:00 a.m. and 10:00 p.m. and at a nonresidential property at any time:(a) Continuous airborne sound which has a sound level in excess of 65 dBAThe proposed decibel level of the air conditioning unit is 75 decibels, whereby the maximum of 65 decibels is allowed. A variance is required.(2) At a residential property line between 10:00 p.m. and 9:00 a.m.:(a) Continuous airborne sound which has a sound level in excess of 50 dBAThe proposed decibel level of the air conditioning unit is 75 decibels, whereby the maximum of 50 decibels is allowed. A variance is required. 7. ßSection 575-170.3 Electric GeneratorsD. Location. Electric generators shall be located in the rear yard, immediately adjacent to the rear wall of the dwelling and at least 20 feet from any property line.A generator must be a minimum of 20 feet from the property line, whereby 17 feet-10 inches and 11 feet-4 inches from the property line is proposed. Variances of 2 feet-2 inches and8 feet-8 inches, respectively, are required. The proposed location of the generator is not immediately adjacent to the wall of the house. 8. ßSection 391-2 Prohibited Noises EnumeratedThe following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this article, but any enumeration herein shall not be deemed to be exclusive:N. A variance is required. The premises also known as Section 1, Block 115, Lot 54 on the Nassau County Land and Tax Map, and are located in the Residence B Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, 767 Middle Neck Road, during regular business hours.
