PLEASE TAKE NOTICE The Board of Trustees of the Village of Kings Point, at a regular meeting held on Wednesday, December 13, 2023, duly adopted Local Law 19 of 2023, which read as follows: 1.Local Law 19 of 2023, a local restricting sculptures in front yards.  Be it enacted by the Board of Trustees of the Village of Kings Point.  Section 1.ß 161-3, Definitions, of Chapter 161, Zoning, of the Code of the Village of Kings Point, is hereby amended, to add the definition of “sculpture”, to read as follows: “SCULPTURE – An object fashioned, designed, sculped, molded, constructed, or otherwise created as a work or art . ”Section 2.Subsection A, of ß 161-23, Projections into required yards, of said Chapter, is hereby amended by adding a new subdivision 3, to read as follows: (3) No sculptures shall be permitted in a front yard except upon the following conditions: (a)The sculpture shall not exceed 4 feet in height. (b)The sculpture shall not cover an area greater that 15 square feet based upon a multiplication of its maximum width by its maximum length.  (c)The sculpture shall not be obscene.  (d)There shall not be more than two sculptures in a front yard.   (e) A sculpture in a front yard on December 31, 2023, that is not obscene, will not have to meet the requirements of subdivisions a, b, and d of this subsection 3. It shall be an affirmative defense in any prosecution for a violation of this subsection that the sculpture was in the front yard on December 31, 2023. A sculpture that qualifies pursuant to this subdivision e may be repaired; but shall not be replaced unless it meets the requirements of either subdivisions a, b, and d, or subdivision f.  (f) A sculpture that does not comply with either subdivisions a, b, and d, or subdivision e of this subsection 3 shall be permitted in a front yard if it is approved by the Architectural and Preliminary Site Review Board.  Section 3. Subsection A, of ß 161-60, Waivers, of said Chapter, is hereby amended by, to read as follows:”A. Notwithstanding anything to the contrary in ß 161-54 and ß 161-59, any person who seeks to: (a) construct or to alter, add to, or reconstruct an existing accessory building; (b) make a change to a building or hardscape; (c) fail to maintain or replant any landscaping; (d) place a sculpture in a front yard; or (e) fail to adhere to any condition of the ARB, which would require the ARB’s prior approval, believes that such construction, altering, addition, reconstruction, sculpture, change, or failure would not have a significant adverse impact upon (i) the preservation or promotion of the character, appearance, or aesthetics of the Village, or (ii) the neighboring properties, may seek a waiver of the ARB’s approval in accordance with the following procedure.” Section 4. Effective date. This local law shall take effect immediately. Dated: Kings Point, New York
