LEGAL NOTICE VILLAGE OF KINGS POINT   

NOTICE IS HEREBY GIVEN that a meeting will be held by the Board of Appeals of the Village of Kings Point at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, on 10th January 2024, at 7:00 p.m.  The Board will immediately adjourn for advice of counsel and, at 7:30 p.m., the Board will commence public hearings for the consideration of the following applications and such other matters as may come before the Board: CASE NO. PRBZA20230519 – Application of Jonathan Bijari, as owner, with regard to the premises at 52 Shore Drive, Kings Point, New York, a legal pre-existing, nonconforming lot in that It only has: ï a net lot area of only approximately 31,101.8 square feet, instead of the required 40,000 square feet; and ï a lot width of only approximately 99 feet, instead of the required 150 feet; and    for variances from sections of the Code of the Village of Kings Point: 1.             §161-10(A): to permit a south front yard of 25.4 feet and a west front yard of 54.6 feet, instead of the required 62.14 feet for both front yards. 2.             §161-10(B): to permit 1. a north side yard of 12.0 feet and a south side yard of 25.4 feet, instead of the required 28 feet for both side yard; and 2. an aggregate side yard of 37.4 feet, instead of the required 65 feet. 3.             §161-23(A)&(B): to permit front and side yard projections greater than permitted, required by the front and side yard variance requests. 4.             §161-23(D)(2)(d):  to permit mechanical equipment in the north and south side yards without the required screening from the public street and adjoining properties. 5. §161-30.1(B):  to permit a floor area of 8,898 square feet, instead of the maximum permitted 6,309.34 square feet. 6.   §161-30.3(A): to permit an impervious coverage in the front yard of 47.5%, instead of the maximum permitted 35%. 7.  §161-30.4(B)(1)(a) & (b): to permit sky plane height variances for the following ridges: 1. in the south front yard: 1. 39.92 feet instead of the maximum permitted 22.26 feet; ii.  27.82 feet instead of the maximum permitted 10.16 feet;    1. in the south side yard: 1. 54.42 feet instead of the maximum permitted 32.91 feet; ii.     38.60 feet instead of the maximum permitted 19.09 feet; 1. in the north side yard: 1. 52.42 feet instead of the maximum permitted 22.82 feet; and ii. 38.62 feet instead of the maximum permitted 9.02 feet. 8.§161-30.4(A): to permit the following height variances: 1. a building height of 32 feet, instead of the maximum 30 feet; 2. a building height 46.16 feet above the average mean grade, instead of the maximum permitted 43.56 feet; and 3. a building with a peaked roof where the dimension between the height and the ridge line is 6.26 feet, instead of the maximum permitted 5 feet. The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 42, Lot 33, located in a Residence A2 zoning district of the Village of Kings Point.   CASE NO. PRBZA20230520 – Application of Jill P. Lamoretti, as owner, with regard to the premises at 152A West Shore Road, Kings Point, New York, for a variance from §161-30.1(A) of Code of the Village of Kings Point to permit a floor area of 8,318.2 square feet, instead of the maximum permitted 8,041.51.  The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 173 Lot 15, and located in a Residence A2 zoning district of the Village of Kings Point.   CASE NO. PRBZA20230522 – Application of Ariel Yehezke and Sharon Yehezkel, as owners, with regards to the premises at One Martin Court, Kings Point, New York, for a variance from §161-35(C} of the Code of the Village of Kings Point to permit a 6-foot high solid panel fence gate  in a front yard where only post and rail and wrought-iron open type fences not exceeding 4 feet in height are permitted. The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 151, Lots 7 & 18, and located in a Residence A2 zoning district of the Village of Kings Point.  The applications and accompanying exhibits are on file in the office of the Village Clerk and may be inspected during normal business hours.   At said hearings, all parties in interest will be given an opportunity to be heard.   In the event that anyone needs a special accommodation for a disability, such person is requested to contact the Village Clerk at least five days before the hearing.                                                      BY ORDER OF THE BOARD OF APPEALS OF THE VILLAGE OF KINGS POINT
