Public Hearings: The Board of Trustees of the Village of Kings Point

PLEASE TAKE NOTICE

The Board of Trustees of the Village of Kings Point will hold public hearings at 6:00 p.m., on Tuesday, August 23, 2022, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bills 12A, 13A, and 14 of 2022, which read, as follows:1. Bill 12A of 2022, a local law amending ß 117-11, Performance of work by Village; assessment of costs, of Chapter 117, Property Maintenance, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †Subsection D of ß 117-11, Performance of work by Village; assessment of costs, of Chapter 117, Property Maintenance, of the Code of the Village of Kings Point, is hereby redesignated as subsection G, and subsections B, C, and D are amended and new subsections E and F are added, subsections B, C, D, E, and F to read, respectively, as follows:ìB. If the Village has effected compliance with this chapter, in whole or in part, or has paid for its effectuation, the actual cost thereof shall be charged to the owner of the property by the Village, and such charge shall become due and payable by the owner at the time of the Village effecting such compliance.îìC. The actual cost for all or any part of the work performed by the Village shall include the following labor, administrative, and legal costs:(1) The total cost to the Village of such employeesí time, administrative and labor, including salary, plus the cost of fringe benefits, which shall include but not be limited to health insurance, life insurance, dental insurance, unemployment, excise, and payroll taxes, retirement benefits, sick leave, vacation, holiday, and personal time off, to the extent applicable, as calculated by the Village Clerk. †The administrative time may be set at either $500 or based upon the actual time spent on the matter.(2) The cost of the Villageís General Counsel at its non-retainer hourly rate.îìD. If the full amount due the Village is not paid within 20 days after a bill for such effectuation is sent by certified mail return receipt requested to the last owner of record as shown on the Villageís assessment roll, then, and in that event, the Building Inspector shall cause to be filed in the office of the Village Clerk a sworn statement showing the cost and expense incurred for the work, the dates the work was performed, the location, by section, block, and lot, of the property on which the work was performed, and the name of owner of the property as shown on the Villageís assessment roll.îìE. The filing of such sworn statement shall constitute a lien on the property and shall remain in full force and effect for the amount due in principal and interest, plus the costs and expenses, including attorneys’ fees, if any, for collection, until final payment has been made. Such interest shall be charged at the accrued legal rate of interest per annum, from the date of the completion of the work or for the Villageís payment for such work. Sworn statements filed in accordance with the provisions hereof:(1) shall be prima facie evidence that all legal formalities have been complied with;(2) that the work has been performed to the satisfaction of the Superintendent of the Building Department; and(3) shall be full notice to every person concerned that the amount of the statement, plus interest, constitutes a charge against the property designated and described in the statement and that the same is due and collectible as provided by law.îìF. In the event that the bill is unpaid when the Village is preparing its next annual assessment roll, the lien shall be added to the assessment roll for the property and collected in the manner fixed by law for the collection of the Village’s real property taxes. †In that event, interest as provided in paragraph D shall be fixed and the full amount, with that fixed interest, shall be subject to a delinquent penalty at the legal rate of interest for Village real property taxes in the event that the same is not paid in full on or before the date the tax bill upon which such charge appears becomes delinquent. Section 2.  Effective date.  This local law shall take effect immediately.2. Bill 13A of 2022, A local law amending Chapter 106, Noise, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1.  Chapter 106, Noise, of the Code of the Village of Kings Point, is hereby by adding a new section, §106-2, to read as follows:§106-2. †Applications to extend the time limits of ß 106-1.A. Upon approval of the Village Police Department, a permit may be granted to extend the time limits of subsection 8 of ß 106-1.(1) The application shall be made by the property owner of the subject property and shall contain the following information and documentation:(a) The name of the owner.(b) The address and section, block, and lot designation of the property.(c) The date and time for which the permit is sought (if it is after midnight, it would be the date after midnight).(d) A check made payable to the Village for the permit fee.(2) Conditions to the permit.(a) The permit shall not exceed more than one hour, so that, in no event shall the extension of time permit the noise between 1:00 a.m. and 8:00 a.m.(b) No permit pursuant to this subsection shall be issued to any person more than one time in any calendar year.(c) No permit pursuant to this subsection shall be issued for any property more than one time in any calendar year.î†Section 2. †Effective date. †This local law shall take effect immediately.3. Bill 14 of 2022, A local law amending the definition of Floor Area in § 161-3. Definitions, of Chapter 161, Zoning, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †Subsection C of the definition of Floor Area, in § 161-3, Definitions, of Chapter 161, Zoning, of the Code of the Village of Kings Point, is hereby amended by adding a new subdivision 4 to read as follows:ì(4) Attic space occurring within a roof assembly that does not exceed 7 feet from the roofís highest point to the roofís lowest point or eave shall not be included as floor area.îSection 2. Effective date. This local law shall take effect immediately.
