INCORPORATED VILLAGE OF GREAT NECK ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING 36 FAIRVIEW AVENUE (Section 1 /Block 51/Lot 1-31) PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Monday, April 17, 2023 at 7:30PM, at Village Hall, 767 Middle Neck Road, Great Neck, NY 11023 to hear the application of Junbo Xia, owner, represented by Ed Dickman, architect, for the premises at 36 Fairview Avenue in Great Neck. The applicant is seeking site plan approval and the following variance(s) from the Village Zoning Codes in connection with his application to construct a new house: 1. §Section 575-84 Front yards. All lots shall have at least one front yard. A corner lot shall have a front yard on each public street on which the lot abuts. All front yards shall have a minimum depth equal to the greater of 20 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet. In no event, however, shall a front yard be required to have a depth which is greater than 35 feet. The average front yard on the west side of Fairview Avenue is 30.08 feet, whereby the minimum of 30.57 feet is required. A variance of .49 feet is required. 2. § 575-85 Side Yards B. On a corner lot, a single-family dwelling shall have only one side yard abutting an interior lot adjacent thereto. Said side yard shall have a minimum width of eight ft, plus 2/5 of the width of the lot in excess of 55 ft measured in the same direction. The side yard shall be on the side adjoining the interior lot opposite the front yard having the greater street frontage. The two yards fronting on public streets shall be considered front yards, as provided by § 575-84, and the remaining yard shall be considered a rear yard and shall conform to the provisions of § 575-86. The proposed side yard is 7.83 feet, whereby a minimum side yard of 12 feet is required. A variance of 4.17 feet is required. 3. § 575-87 Permitted Encroachments A. The following encroachments into required yards are hereby permitted: (6) Unenclosed and unroofed platform and steps, designed to provide safe access to grade from service entrance doors, may extend not more than three feet six inches into a minimum side yard. The maximum horizontal surface of any encroaching platform shall not exceed 14 SF. The stoop and the steps to the side door encroach more than the 3 feet allowed. With the permitted encroachment, the side yard minimum is 9 feet, whereby 4.83 feet is proposed. A variance of 4.17 feet is required. The premises also known as Section 1, Block 51, Lot 1-31 on the Nassau County Land and Tax Map, and are located in the Residence C Zoning District.
