NOTICE OF PUBLIC HEARING, BUDGET VOTE AND ELECTION OF MEMBERS OF THE BOARD OF EDUCATION OF THE FLORAL PARK-BELLEROSE UNION FREE SCHOOL DISTRICT, TOWNS OF HEMPSTEAD AND NORTH HEMPSTEAD, NASSAU COUNTY, NEW YORK NOTICE IS GIVEN that a public hearing of the qualified voters of the Floral Park-Bellerose Union Free School District, Nassau County, New York, will be held at 7 30 p.m., on May 13, 2024, at the John Lewis Childs School, Elizabeth Street, Floral Park, New York, for the presentation and consideration of the proposed Elementary School District Budget for the 2024-25 school year. FURTHER NOTICE IS GIVEN that the vote on the budget and any propositions that may properly be brought before the voters, and the election of two members of the Board of Education, will be held on May 21, 2024, from 7 00 a.m. to 9 00 p.m. at the John Lewis Childs School, Elizabeth Street, Floral Park, New York, and at the Floral Park-Bellerose School, Larch Avenue, Floral Park, New York at which time the polls will be open for voting by voting machines upon the following items 1. Adoption of the Elementary School District Budget. The proposition which will appear on the ballot is FLORAL PARK-BELLEROSE UNION FREE SCHOOL DISTRICT – ELEMENTARY SCHOOL BUDGET RESOLVED, that the proposed budget of expenditures of the Floral Park-Bellerose Union Free School District, Towns of Hempstead and North Hempstead for the fiscal year 2024-2025 in the amount of $39,539,684 (Thirty-Nine Million, Five Hundred Thirty-Nine Thousand, Six Hundred Eighty-Four and 00 100 Dollars) and for the purposes shown in the statement thereof presented to and at the Budget Hearing of said School District be approved and the amount thereof raised by a levy of a tax upon the taxable property within said School District after first deducting the monies available from state aid and other sources as provided by law. 2. The expenditure from the Capital Reserve Fund for School Building Improvement Projects. The proposition which shall be voted upon, and which will appear on the ballot is FLORAL PARK-BELLEROSE UNION FREE SCHOOL DISTRICT – CAPITAL RESERVE FUND EXPENDITURE SHALL the Board of Education (the “Board”) of the Floral Park-Bellerose Union Free School District (“District”), be authorized to expend no more than two million three hundred four thousand two hundred sixty three dollars ($2,304,263) from the Capital Reserve Fund – 2021, established on May 18, 2021 (“Reserve Fund”) plus any accumulated interest pursuant to Section 3651 of the Education Law, to undertake and perform certain school building improvement projects including portions of the Boiler Conversion project and HVAC replacement systems District-wide and any project described in the District’s Five Year Capital Facilities Plan (“Plan”) dated May 31, 2023, all at no additional cost to District taxpayers; said projects to commence during the 2024-25 school year to consist of certain capital improvements, construction, reconstruction, renovations and or alterations in all District buildings and facilities and the sites thereof, including (as and where necessary) security improvements; interior renovations; paving work; and HVAC upgrades; all of the foregoing to include site improvements, furnishings, equipment, apparatus, machinery, demolition and other incidental work or improvements required in connection therewith, and to expend from the Reserve Fund therefor, including preliminary costs and costs incidental thereto and to the financing thereof; such costs of the components of the capital improvements projects may be reallocated among such components projects as the Board shall determine to be in the best interest of the District. 3. The election of two (2) members of the Board of Education as follows one (1) member to be elected for a full three-year term to fill the vacancy created by the expiration (as of June 30, 2024) of the term of office of Beth Kierez, for a new term to commence on July 1, 2024. One (1) member to be elected for a full three-year term to fill the vacancy created by the expiration (as of June 30, 2024) of the term of office of Jaclyn O’Donohue, for a new term to commence on July 1, 2024. FURTHER NOTICE IS GIVEN, that candidates for office of member of the Board of Education shall be nominated by petition. Each vacancy upon the Board of Education to be filled shall be considered a separate specific office. A separate petition is required to nominate a candidate to each separate office. Each petition shall be directed to the District Clerk, shall be signed by at least twenty-five (25) qualified voters of the School District, shall state the residence of each signer and shall state the name and residence of the candidate and shall describe the specific vacancy on the Board of Education for which a candidate is nominated, which description shall include at least the length of the term of office and the name of the last incumbent, if any. Each petition shall be filed in the District Clerk’s office, 1 Poppy Place, Floral Park, New York, from 9 00 a.m. to 5 00 p.m., not later than the 30th day preceding the election, this year April 22, 2024. No person shall be nominated by petition for more than one separate office. FURTHER NOTICE IS GIVEN that pursuant to a rule adopted by the Board of Education in accordance with Education Law §2035, any propositions to be submitted for voting at said election which are not required to be placed in the legal notice must be filed in the District Clerk’s office, no later than 5 00 p.m. on April 22, 2024; must be typed or printed; must be directed to the District Clerk; must be signed by qualified voters totaling at least 5% of the number of voters who voted in the previous annual election of members of the Board of Education (this year, 43 signatures of qualified voters are required); and must legibly state the name and address of each signer. The Board of Education will not place before the voters any proposition the purpose of which is not within the power of the voters, any proposition requiring the expenditure of moneys that fails to include the necessary specific appropriation, or where any other valid reason exists for excluding the proposition from the ballot. FURTHER NOTICE IS GIVEN that pursuant to Real Property Law §495, pursuant to Chapter 258 of the Laws of 2008, Section 495 was added to the Real Property Tax Law, and requires the School District to attach to its proposed budget an exemption report. Said exemption report, which will also become part of the final budget, will show how much of the total assessed value on the final assessment roll used in the budgetary process is exempt from taxation, list every type of exemption granted, identified by statutory authority, and show (a) the cumulative impact of each type of exemption expressed either as a dollar amount of assessed value or as a percentage of the total assessed value on the roll; (b) the cumulative amount expected to be received from recipients of each type of exemption as payments in lieu of taxes or other payments for municipal services; and (c) the cumulative impact of all exemptions granted. The exemption report shall be posted on any bulletin board maintained by the District for public notices and on any website maintained by the District. In accordance with Education Law §§ 2018-a and 2018-e, completed absentee and early mail ballot applications may not be received by the District Clerk earlier than 30 days prior to the election (i.e., April 22, 2024), and must be received by the District Clerk at least seven (7) days before the election (i.e., May 14, 2024) if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter or to the agent named in the absentee or early mail ballot application. Absentee and early mail ballots must be received by the District Clerk not later than 5 00 p.m., prevailing time, on Tuesday, May 21, 2024. Completed applications must be personally delivered or mailed to the District Clerk and received no later than 5 00 p.m. on April 25, 2024. Military ballots must be received by 5 00 p.m. on May 21, 2024, if signed and dated by the military voter and one witness thereto with a date which is not later than the day before the election, or not later than the close of the polls on May 21, 2024, if postmarked or endorsed by an agency of the United States government. A military voter may designate a preference to receive a military voter registration form, military ballot application or military ballot by mail, facsimile or electronic mail in the request for such registration, ballot application, or ballot. FURTHER NOTICE IS GIVEN that personal registration of voters is required under Education Law §2014 and Article 5 of the Election Law. If a voter has registered pursuant to Education Law §2014 and has voted at any annual or special district meeting or election within the prior four (4) calendar years, such voter is eligible to vote at this election.
