LEGAL NOTICE OF
PUBLIC HEARING
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Roslyn Estates will hold a public hearing at 7:30 PM on Monday, March 28, 2022, at the Village Hall, 25 The Tulips, Roslyn, New York 11576, to consider the adoption of the following matter: Bill 3 of 2022, A local law amending §80-4, ‘Contents of development plan,’ of Chapter 80, ‘Grading and Filling,’ §145-5, ‘Submission of application; review; certification, approval; bond,’ of Chapter 145, ‘Site Plan Approval,’ and §167-10, ‘Preliminary Layout procedure,’ of Article III, ‘Subdivision Procedure,’ of Chapter 167, ìSubdivision of Land,’ of the Code of the Village of Roslyn Estates to Address Applications for Tree Removal relating to Applications to the Planning Board. Section 1. Legislative Findings. The Board of Trustees of the Village of Roslyn Estates, through the Village Tree Code, has determined that the preservation of existing trees and the planting of trees promotes the health, safety and welfare of the Village and its residents.† The Board recognizes that an applicant to the Planning Board for grading and filling, site plan or subdivision approval with respect to a proposed land use project may also seek a permit to remove trees in connection with such project.† The Board finds that the health, safety and welfare of the Village and its residents is served by amending the Chapters of the Village Code under which the Planning Board has jurisdiction to consider grading and filling, site plan or subdivision applications to require that the Village Official or Board having jurisdiction with respect to applications for tree removal provides input to the Planning Board before the Planning Board renders a decision with respect to any application for grading and filling, site plan or subdivision approval when the applicant also seeks a permit to remove trees in connection with the project that is the subject of such application to the Planning Board. Section 2. Authority. This local law is adopted pursuant to the New York State Municipal Home Rule Law.† †Section 3. Section 80-4, ìContents of development plan,’ of Chapter 80, ‘Grading and Filling,’ of the Code of the Village of Roslyn Estates is hereby amended to add, at the end thereof, immediately after the end of clause ‘F.’ thereof, a new clause ‘G.’, to read in its entirety as follows: ‘G. Input with respect to proposed tree removal. The Planning Board shall refrain from rendering a decision with respect to any grading or fill application if the applicant requires a tree removal permit under Chapter 184 for any aspect of the project that is the subject of the grading or fill application, until the Planning Board has obtained input from the Village Official or Board having jurisdiction with respect to applications for tree removal; each applicant for grading or fill approval must state in his application either that he has duly applied to the Village for permits to remove all trees that he proposes to remove in connection with the proposed project, in which case a copy of such tree permit application shall be submitted as part of the grading or fill approval application, or that no trees are proposed to be removed in connection with the project.’ Section 4. Section 145-5, ìSubmission of application; review; certification, approval; bond,’ of Chapter 145, ìSite Plan Approval,” of the Code of the Village of Roslyn Estates is hereby amended to add, at the end thereof, immediately after the end of clause ìE.î thereof, a new clause ‘F.’, to read in its entirety as follows: ‘F. Input with respect to proposed tree removal. The Planning Board shall refrain from rendering a decision with respect to any application for site plan approval if the applicant requires a tree removal permit under Chapter 184 for any aspect of the project that is the subject of the site plan application, until the Planning Board has obtained input from the Village Official or Board having jurisdiction with respect to applications for tree removal; each applicant for site plan approval must state in his application either that he has duly applied to the Village for permits to remove all trees that he proposes to remove in connection with the proposed project, in which case a copy of such tree permit application shall be submitted as part of the site plan approval application, or that no trees are proposed to be removed in connection with the project.’ Section 5. Section 167-10, ìPreliminary Layout procedure,’ of Article III, ìSubdivision Procedure,’ of Chapter 167, ìSubdivision of Land,’ of the Code of the Village of Roslyn Estates is hereby amended to add, at the end thereof, immediately after the end of clause ìF.’ thereof, a new clause ‘G.’, to read in its entirety as follows:’G. Input with respect to proposed tree removal. The Planning Board shall refrain from rendering a decision with respect to any application for subdivision approval if the applicant requires a tree removal permit under Chapter 184 for any aspect of the project that is the subject of the subdivision application, until the Planning Board has obtained input from the Village Official or Board having jurisdiction with respect to applications for tree removal; each applicant for subdivision approval must state in his application either that he has duly applied to the Village for permits to remove all trees that he proposes to remove in connection with the proposed project, in which case a copy of such tree permit application shall be submitted as part of the subdivision approval application, or that no trees are proposed to be removed in connection with the project.’ Section 6.
