LEGAL NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE that the Board of Trustees of the Village of Roslyn Estates will hold a public hearing at 7:30 PM on Monday, February 28, 2022, at the Village Hall, 25 The Tulips, Roslyn, New York 11576, remotely, via videoconference only, with no ìin personî location, as authorized pursuant to NYS legislation (S.50001/A.40001) extending virtual access to public meetings under New York Stateís Open Meetings Law, which allows New York government agencies to virtually conduct public meetings during the COVID-19 pandemic, to consider the adoption of the following matter: †Bill 1 of 2022, A local law amending ß 200-68, ìPowers and Duties,î of Article XII, ìZoning Board of Appeals,î of Chapter 200, ìZoning,î of the Code of the Village of Roslyn Estates to Address Applications for Tree Removal relating to Applications for Zoning Variances Section 1.  Legislative Findings. The Board of Trustees of the Village of Roslyn Estates, through the Village Tree Code, has determined that the preservation of existing trees and the planting of trees promotes the health, safety and welfare of the Village and its residents.† The Board recognizes that an applicant to the Zoning Board of Appeals for zoning variances with respect to a proposed land use project may also seek a permit to remove trees in connection with such project.† The Board finds that the health, safety and welfare of the Village and its residents is served by amending the Zoning Chapter of the Village Code to require that the Village Official or Board having jurisdiction with respect to applications for tree removal provides input to the Zoning Board before the Zoning Board renders a decision with respect to any application for zoning variance when the applicant also seeks a permit to remove trees in connection with the project that is the subject of such variance application. Section 2. Authority.  This local law is adopted pursuant to the New York State Municipal Home Rule Law. Section 3.  Section 200-68, ìPowers and Duties,î of Article XII, ìZoning Board of Appeals,î of Chapter 200, ìZoning,î of the Code of the Village of Roslyn Estates is hereby amended to add, at the end thereof, immediately after the end of clause ìJ.î thereof, a new clause ìK.î, to read in its entirety as follows: ìK. Refrain from rendering a decision with respect to an application for variance from any provision of this chapter if the applicant requires a tree removal permit under Chapter 184 for any aspect of the project that is the subject of the application, until the Zoning Board has obtained input from the Village Official or Board having jurisdiction with respect to applications for tree removal; each applicant for variance must state in his application either that he has duly applied to the Village for permits to remove all trees that he proposes to remove in connection with the proposed project, in which case a copy of such tree permit application shall be submitted as part of the variance application, or that no trees are proposed to be removed in connection with the project.î  Section 4.   Effective Date.† This local law shall take effect immediately upon filing with the Secretary of State.  Persons who may suffer from a disability which would prevent them from participating in said hearing should notify Michael Tomicich, Village Clerk, at (516) 621-3541 in sufficient time to permit such arrangements to be made to enable such persons to participate in said hearing.
