NOTICE OF PUBLIC HEARING
6 RUTH COURT (Section 2 /Block 348/Lot(s) 59)PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, November 3, 2022 at 7:30PM at Saddle Rock Village Hall, 18 Masefield Way, Great Neck, NY 11023, to hear the application of Diana Shapiro, owner, represented by Michael Rant, engineer, for the premises at 6 Ruth Court in Great Neck. The applicant is seeking the following variance(s) from the Village Zoning Codes for an application to construct retaining walls and accessory structures:1. §Section 575-57 Side YardA. On an interior lot, a single-family dwelling shall have two side yards, one on each side of the main building. The aggregate width of the two side yards shall not be less than 20 feet, plus 1/2 of the width of the lot in excess of 60 feet. No side yard shall have a width of less than eight feet, plus 2/5 of that portion of the minimum required aggregate width of both side yards in excess of 20 feet. Where practical, the wider of the two side yards shall be placed adjacent to the narrower of the side yards of an adjoining lot or lots. Lot coverage on a residential lot in the Residence B District shall not exceed the following thresholds:The proposed aggregate side yard is 15.8 feet, whereby the minimum aggregate side yard requirement is 37.2 feet. †A variance of 21.4 feet is requested. 2. §Section 575-57 Side YardA. On an interior lot, a single-family dwelling shall have two side yards, one on each side of the main building. No side yard shall have a width of less than eight feet, plus 2/5 of that portion of the minimum required aggregate width of both side yards in excess of 20 feet. Lot coverage on a residential lot in the Residence B District shall not exceed the following thresholds:The proposed side yard is 4 feet, whereby the minimum side yard requirement is14.9 feet. †A variance of 10.9 feet is requested. 3. §Section 528-5 Application for PermitC. The decision of the Building Inspector shall be based upon the following criteria:(1) The condition of the tree or trees the applicant seeks to remove with respect to disease and danger of falling, proximity to existing or proposed structures and interference with utility services.(2) The necessity of the removal or alteration of the tree or trees in question.(3) The effect of the removal or alteration thereof on ecological systems.(4) The character established at the proposed site of removal or alteration with respect to existing vegetation management practices.(5) The impact of any removal or alteration upon existing screening of any public street bordering the property. The proposed tree removal is not compliant with the required criteria. The premises also known as Section 2, Block 348, Lot 59 on the Nassau County Land and Tax Map, and are located in the Residence B Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, 767 Middle Neck Road, during regular business hours.
