NOTICE OF PUBLIC BUDGET HEARING AND ANNUAL DISTRICT MEETING AND ELECTION OF THE PORT WASHINGTON UNION FREE SCHOOL DISTRICT, TOWN OF NORTH HEMPSTEAD, COUNTY OF NASSAU, STATE OF NEW YORK
PLEASE TAKE NOTICE that a Public Budget Hearing of the Port Washington Union Free School District, Nassau County, Port Washington New York, will be held at the Paul D. Schreiber High School, 101 Campus Drive, Port Washington, NY 11050 or virtually as appropriate on Tuesday, May 2, 2023 at 8:00 p.m., Eastern Daylight Savings Time (E.D.S.T.) at which the proposed District Budget for the 2023-2024 school year will be presented and explained.
NOTICE is also given that the Annual District Meeting and Election will occur on Tuesday, May 16, 2023, for the purpose of enabling the District’s properly registered and qualified voters to: (i)vote on the District budget for the 2023-2024 school year (which shall appear on the ballot as (Proposition No. 1); (ii) elect two (2) members of the Board of Education; and (iii) vote on any additional matters in accordance with applicable law. Voting will occur at the Weber Middle School All Purpose Room, 52 Campus Drive, Port Washington, New York in said District. The polls will be open between the hours of 6 a.m. and 10 p.m., E.D.S.T. Ballots will be cast upon voting machines, or otherwise as in accordance with the law.
NOTICE is also given that a copy of a detailed written statement prepared by the Board of Education setting forth the amount of money which will be required for school purposes for the fiscal year ending June 30, 2024, and specifying the several purposes and the amount of each, shall be available to any resident of the District, upon request, beginning Tuesday, May 2, 2023: at the Public Budget Hearing or virtually as appropriate; during regular business hours at the District offices, located at 100 Campus Drive, Port Washington, NY, 11050; between the hours of 9 a.m. and 2 p.m. on each day other than a Saturday, Sunday, or holiday, at Schreiber High School, Weber Middle School, and Daly, Guggenheim, Manorhaven, Sousa, and South Salem Elementary Schools; at the Port Washington Public Library; on the District’s internet website at www.Portnet.org; and at the polling place on voting day.
NOTICE is also given that in accordance with §4 95 of the New York Real Property Tax Law, the District shall prepare a Real Property Tax Exemption Report” which will show how much of the assessed value on the final assessment roll (utilized for the school tax Levy) is exempt from taxation by the School District. This exemption report will list every type of exemption granted and will show: (1) the cumulative impact of each type of exemption; (2) the cumulative amount expected to be received as payment in lieu of taxes (PILOTS), or other payments from recipients of each type of exemption; (3) the cumulative impact of all exemptions granted. This Exemption Report will be posted on the District’s website and on District bullet boards utilized for posting public notices. The Exemption Report will be annexed to any preliminary District budget and will become part of the final budget.
NOTICE is also given that two (2) members of the Board of Education will be elected due to the expiration of the terms of Board members Julie Epstein and Rachel Gilliar. The two (2) candidates receiving the greatest number of votes shall be elected to three-year terms, to commence on July 1, 2023.
Petitions nominating candidates for the office of member of the Board of Education must be filed with the District Clerk between the hours of 9 a.m. and 5 p.m. not later than Monday, April 17, 2023. Each nominating petition must be directed to the District Clerk, must state the name and residence of each signer, and must state the name and residence of the candidate. A sample form of petition may be obtained from the District Clerk. The law requires that a nominating petition contain the signatures of at least 63 qualified voters in the District.
Pursuant to a proposition adopted by the voters, vacancies upon the Board of Education are not considered separate, specific offices, and nominating petitions need not describe any specific vacancy upon the Board of Education for which the candidate is nominated.
NOTICE is also given that the only persons entitled to vote on May 16, 2023 are qualified voters” that is, persons who are citizens of the United States, at least 18 years of age, who have been residents of District for a period of 30 days immediately preceding May 16, 2023. In addition, persons seeking to vote must be registered to vote. Registration is permitted daily, on days when school is in session, in the Office of the District Clerk (located in the Administration Building at 100 Campus Drive), during the hours of 9:00 a.m. to 3:00 p.m., up to and including May 11, 2023.
The register of qualified voters shall include qualified voters who have registered to vote previously and have voted in any annual or special school district meeting or election of the District within the four prior calendar years; and qualified voters of the school district who are registered with the Nassau County Board of Elections to vote in general elections, pursuant to the provisions of Article 5 of the Election Law.
The Register shall be filed in the Office of the District Clerk, located at the Administration Building, 100 Campus Drive, Port Washington, New York, where it shall be open for inspection by any qualified voter between the hours of 9:00 a.m. and 4:00 p.m. on each of the five days prior to the date of the Annual District Meeting and Election, except Saturday and Sunday; and it shall also be open for inspection at the polling place on election day.
NOTICE is also given that applications for absentee ballots may be obtained between the hours of 9:00 a.m. and 3:00 p.m. Monday through Friday, except holidays, from the District Clerk. Completed applications must be received by the District Clerk at least seven (7) days before the election if the ballot is to be mailed to the voter, or the day before the election, if the ballot is to be delivered personally to the voter. Absentee ballots that do not reach the office of the District Clerk by 5:00 p.m. on Tuesday, May 16, 2023 will not be canvassed.
A list of all persons to whom absentee voter ballots have been issued shall be available for public inspection to qualified voters of the District in the office of the District Clerk during regular office hours until the day of the election. NOTICE is also given that military voters who are not currently registered may apply to register as qualified voters of the school district. Military voters may request an application to register as a qualified voter from the District Clerk. Military voter registration application forms must be received in the Office of the District Clerk no later than 5:00 p.m. on April 20, 2023. In order for a military voter to be issued a military ballot, the school district must have received in the office of the school district clerk a valid ballot application no later than 5:00 pm on April 20, 2023. A military voter may designate a preference to receive a military voter registration, military ballot application or military ballot by mail, facsimile transmission or electronic mail in their request for such registration, ballot application, or ballot. Such designation shall remain in effect until revoked or changed by the military voter. Ballots for military voters shall be mailed, or otherwise distributed, no later than April 21, 2023.
NOTICE is also given that the Board of Education shall convene a special Board meeting within twenty-four (24) hours after the filing with the District Clerk of a written report of the results of the ballot by the Chief Election Inspector for the purpose of examining and tabulating said report of the result of the ballot and declaring the result of the ballot; and further, that the Board hereby designates itself to be a set of poll clerks for the purpose of canvassing affidavit ballots cast pursuant to Education Law section 201 9-a(2)(b) at said special meeting of the Board.
Section 4. That the District Clerk is hereby authorized and directed to cause Notice to be given in the form hereinabove prescribed by publishing the same in the Port Washington News” and Port Washington Times”, two newspapers having general circulation within the School District, four times during the seven (7) weeks preceding said vote and election, the first publication to be at least forty-five (45) days prior to said vote and election, but not sooner than the forty-nine (4 9) days prior to said vote and election; provided, however, that the District Clerk is hereby authorized, without further Board action, in her discretion, in consultation with the District’s legal counsel, to amend said Notice, as necessary to assure compliance with applicable law.
Section 5. This resolution shall take effect immediately.
