LEGAL NOTICE

VILLAGE OF KINGS POINT NOTICE IS HEREBY GIVEN that a meeting will be held by the Board of Appeals of the Village of Kings Point at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, on 24th May 2022, at 7:00 p.m.   The Board will immediately adjourn for advice of counsel and, at 7:30 p.m., the Board will commence public hearings for the consideration of the following applications and such other matters as may come before the Board:  CASE NO. PRBZA20220127 – Application of 38 MCT LLC (Joseph Roubeni), as owner, with regard to the premises at 38 Martin Court, Kings Point, New York, for a variance from the following section of the Code of the Village of Kings Point to construct a swimming pool and appurtenant equipment that will encroach 5.6 feet into a 114.3-foot front yard (Sinclair Drive):  §  140-5 Setbacks:   No swimming pool and no appurtenant equipment or structure to such swimming pool shall be built, constructed, erected or maintained in a front yard or closer than 20 feet to the rear or side property lines of the premises.  The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 150, Lot 20, and located in a Residence A2 zoning district. CASE NO. PRBZA20220128 ñ Application of 2GDS3 LLC, as owner, with regard to the premises at 40 Shore Drive, Kings Point, New York, for a variance from the following section of the Code of the Village of Kings Point to construct an open shade trellis with retractable roof at the existing dwelling: § 161-24(A)(6):   to permit a 10.625 feet high accessory building, 5.21 feet from the property line along Manhasset Bay, thereby creating an encroachment of 5.41 feet set back. The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 42, Lots 26-29, and located in a Residence A2 zoning district. CASE NO. PRBZA20220134 – The application of Payam Yadidi, as owner, with regard to the premises at 19 Foxwood Road, Kings Point, New York, for variances from the following sections of the Code of the Village of Kings Point to permit a new single-family dwelling:  1.§  161-30.4(A): to permit a building height of 32.2 feet, instead of the maximum building height of 28 feet.2. §  161-30.4(B)(1)(b): to permit a side (north) sky exposure plane of 42.27 feet, instead of the maximum permitted 42.06 feet.3. §  161-23(C): to permit a shoreline yard of 50.75 feet, instead of the required 96.66 feet.  The premises are shown on the Nassau County Land and Tax Map as Section1, Block 177, Lot 34, andlocated in a Residence A2 zoning district.  The applications and accompanying exhibits are on file in the office of the Village Clerk and may be inspected during normal business hours.  At said hearings, all parties in interest will be given an opportunity to be heard.  In the event that anyone needs a special accommodation for a disability, such person is requested to contact the Village Clerk at least five days before the hearing.  All persons entering the Village Hall may be required to wear facemasks covering their nose and mouth at all times and maintaining a 6-foot social distance.
