BRISTOL, SS. CASE NO. 23MISC 000218 (RBF) Bank of America, N.A. v. Clearlight Mortgage Corp. f/k/a Coastal Capital Corp., et al. TO: any former stockholders, officers, creditors and any other persons claiming any interest in Clearlight Mortgage Corp. f/k/a Coastal Capital Corp. an inactive foreign corporation formerly located in Greenvale, in the state of New York, or their heirs, devisees, legal representatives, successors, or assigns You are hereby notified that a complaint has been filed by the above-named plaintiff in which you are named as an interested party. This complaint concerns a certain parcel of land in Easton, Bristol County, and said Commonwealth, being known as and numbered 109 Black Brook Road. Title to said parcel is clouded by a mortgage given by James M. Petrillo and Kimberly A. Petrillo to Clearlight Mortgage Corp. f/k/a Coastal Capital Corp. d/b/a The Mortgage Shop, said mortgage being dated March 2, 2003, and recorded with the Bristol North Registry of Deeds in Book 11858, Page 339. Coastal Capital Corp. d/b/a The Mortgage Shop subsequently assigned the Mortgage to Countrywide Home Loans, Inc. (f/k/a Countrywide Funding Corporation) but for unknown reasons this assignment was never recorded and is now lost, its whereabouts unknown. On July 1, 2004, a Discharge of Mortgage was executed by Countrywide Home Loans, Inc. (f/k/a Countrywide Funding Corporation) discharging the above referenced Mortgage. The Discharge was recorded on July 16, 2004, with said Registry in Book 13883, Page 61. Bank of America acknowledges that the borrowers paid the Note in full on May 14, 2004. However, due to the lack of recorded assignment to Bank of America or any of its acquired entities, Plaintiff remains outside the chain of title and unable to discharge the Mortgage after receiving payment in full. Plaintiff alleges that all obligations secured by the aforementioned mortgage have been performed, and that it is entitled to a discharge to clear the record and seeks a judgment to that effect. A copy of said complaint may also be obtained from plaintiff’s attorney. If you intend to make any defense, you are hereby required to serve upon the plaintiff’s attorney, Denise A. Chicoine, Esq. of Englander & Chicoine P.C., whose address is One Boston Place, 26th Floor, Boston, MA 02108, an answer to the complaint on or before the fourth day of December, 2023, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day. If you fail to do so, judgment by default will be taken against you for relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiffs’ claim, or you will thereafter be barred from making such claim in any other action. It is ORDERED that notice be given by publishing a copy of this notice once in The Roslyn Times, a newspaper published in Greenvale, New York, at least thirty days before the fourth day of December, 2023.
