Public Notice by the Board of Commissioners of the New Hyde Park Fire District PLEASE TAKE NOTICE, that the Board of Commissioners (“the Board”) of the New Hyde Park Fire District (hereinafter “the District”) has made its determination and findings concerning the proposed acquisition of real property for firehouse expansion and other firemanic purposes, which land is known as part of certain lands as shown on the Land and Tax Map of Nassau County as Section 8, Block 10, Lots 35-48, and also known as part of 1011 Lakeville Road, New Hyde Park, New York, as shown on a vesting map, as amended, dated September 16, 2022 titled “Map of Property to be acquired by the New Hyde Park Fire District by Eminent Domain” drawn by Barrett, Bonacci & Van Weele, PC (hereinafter “the vesting map”).A brief synopsis of each such determination is as follows:a. That the District’s Lakeville Road Firehouse apparatus floor lacks sufficient space to safely operate the assigned pumper truck from that location;b. That the garages located at the rear of the District’s Lakeville Road Firehouse lack sufficient room for safe ingress and egress of equipment from the garages;c. That the apparatus floor for the pumper truck needs to be relocated to the south of the existing apparatus floor in order to increase the depth and height of the apparatus floor and bay;d. That relocating the apparatus floor on the District’s existing property would be cost prohibitive;e. That the District requires a 10 ft. wide strip of property from the adjourning parcel at 1011 Lakeville Road in order to build the apparatus floor and bay, which 10 ft. wide fee acquisition would run from the current set back from Lakeville Road of the present firehouse to the rear of the property at 1011 Lakeville;f. In addition, the District requires a 10 ft. wide non-exclusive permanent easement over 1011 Lakeville Road running 27 ft. from Lakeville Road to the commencement of the 10 ft. wide fee acquisition.g. The non-exclusive permanent easement will permit ingress and egress by both the District’s equipment and members and traffic associated with 1011 Lakeville Road over the permanent easement area;h. There are no viable alternative locations for this project, as the Lakeville Road Firehouse serves a distinct geographic region within the District, and the property to be acquired is uniquely situated to meet the District’s needs.i. There is no adverse impact on the environment in the area of the project.PLEASE TAKE FURTHER NOTICE, under Section two hundred seven of the Eminent Domain Procedure Law, there are thirty (days from the completion of the condemnor’s newspaper publication requirement to seek judicial review of the condemnor’s determination and findings; and be further advised under Section two hundred seven and two hundred eight of the Eminent Domain Procedure Law, the exclusive venue for judicial review of the condemnor’s determination and findings is the appellate division of the supreme court in the judicial department where any part of the property to be condemned is located.Copies of the full determinations and findings are available at the District Headquarters Building, 1555 Jericho Turnpike, New Hyde Park, New York, and will be forwarded upon written request without costs.
