The Board of Trustees of the Village of Kings Point will hold public hearings at 9:00 a.m., on Wednesday, April 27, 2022, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bills 2, 4, 5, and 6A of 2022, which read, respectively, as follows:1. Bill 2 of 2022, a local law amending the zoning provisions of the Code of the Village of Kings Point with regard to tennis courts and off-shore structures. Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. §161-41, Screening, of Article VI, Private Tennis Courts, of Chapter 161, Zoning, of the Code of the Village of Kings Point, is hereby amended, to read as follows:ì§ 161-41. †Screening.All tennis courts and the fencing surrounding the same shall be completely screened from adjoining properties by a living screen of coniferous trees. The trees shall consist of Canadian hemlock or an alternate approved by the Building Inspector. The height of the trees, when planted, shall be at least six feet and in no event less than two feet below the maximum height of the fence surrounding the court. The trees shall be planted at intervals of five feet on center, or if an alternate other than Canadian hemlock is approved by the Building Inspector, then at those intervals which the Building Inspector determines will achieve the same screening effect as Canadian hemlocks. The coniferous screening shall be maintained in good condition so long as the tennis court remains in existence.Notwithstanding the foregoing, with regard to waterfront properties, the Architectural and Preliminary Site Review Board may waive the requirement for screening a tennis court from the waterfront if it finds that such screening is not required for the benefit of adjoining properties.îSection 2. § 161-50.3, Application process for permit for construction or maintenance; filing fees and deposits, of Article VIII, Off-Shore Structures, of said chapter, is hereby amended by redesignating subsection E as subsection G, and adding new subsections E and F, to read, respectively, as follows:ìE. The application shall be accompanied by a plan that shows all off-shore structures within 400 feet of the subject property.îìF. The applicant shall send notice of the application to the property owners of all properties within 400 feet of the subject property.îSection 3. †Effective date. †This local law shall take effect immediately.2. †Bill 4 of 2022, a local law amending Chapter 25, Notice to Property Owners, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †Subsection A, of ß 25-1, Requirements for applicant’s notice to property owners, of Chapter 25, Notice to Property Owners, of the Code of the Village of Kings Point, is hereby amended, to read as follows:ìA. Whenever an applicant to any board or commission of the Village is required to send notices to property owners or others with regard to its application, such notices shall be sent by the applicant using either or a combination of the following two methods:(1) By a nationally recognized overnight courier service, for priority overnight next-day delivery, without requiring a signature by the recipient.(2) By:Hand delivery to a person of suitable age and discretion at the ownerÃs mailing address, andFirst class mail.Such notices shall be sent and/or hand-delivered, as the case may be, not more than 25 days nor less than 17 days before the date of the next meeting at which the application will be addressed.îSection 2. †Effective date. †This local law shall take effect immediately.3. †Bill 5 of 2022, a local law authorizing the Village of Kings Point to levy a property tax in excess of the limit established in General Municipal Law ß3-c.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †Legislative Intent.A. Pursuant to Chapter 97 of the Laws of 2011, the New York State Legislature has enacted a ìtax levy limitî applicable to the Village budget. †As a consequence of the severe limitations imposed by that legislation and the complexities of the legislation, the Village may exceed the levy limit for the next ensuing Village fiscal year. †B. While the Village Board of Trustees continually strives to keep taxes to a minimum, the State continues to annually add costly new unfunded mandates to the existing burdensome ones, which requires the Village to make costly expenditures, without the State granting any funds to offset those State mandated expenditures.C. Because the tax levy limit imposed by the State legislation permits only a minimal increase in the Village tax levy, it may be insufficient to accommodate future expenses. †D. The consequences of exceeding, even inadvertently, the tax levy limit are severe for the Village and future Village budgets. †Accordingly, although the Village Board of Trustees does not plan on exceeding the tax levy limit for the fiscal year commencing June 1, 2022, the Board hereby determines that it is in the best interests of the Village, its residents, and taxpayers that the Village be authorized to adopt a budget for the fiscal year June 1, 2022, which would allow for a real property tax levy in excess of the ìtax levy limitî as defined by General Municipal Law ß 3-c, in the event that the Village inadvertently exceeds that limit.Section 2. †Authority.This local law is adopted pursuant to subdivision 5 of General Municipal Law ß3-c, which expressly authorizes a local governmentÃs governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent of said governing body. †Section 3. †Tax Levy Limit Override.The Board of Trustees of the Village of Kings Point, County of Nassau, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2022 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law ß3-c.Section 4. †Severability.If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm, or corporation, or circumstance is invalid or unconstitutional, the courtÃs order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm, or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.Section 5. †Effective date.This local law shall take effect immediately.4. †Bill 6A of 2022, a local law amending Chapter 30, Police Commissioners, Board of, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †ß 30-2, ß 30-3, and ß 30-4, of Chapter 30, Police Commissioners, Board of, of the Code of the Village of Kings Point, are hereby amended to read, respectively, as follows:ìß 30-2. †Establishment; composition.A. Pursuant to the authority vested in the Board of Trustees under Village Law ß 3-308, Subdivision 2, a separate Board of Police Commissioners is hereby established in the Village of Kings Point.B. The Commission shall consist of three members.îìß 30-3. †Appointments; residency of Chairman.A. The Commissioners shall be appointed by the Mayor of the Village, which appointment shall be approved by the Board of Trustees in accordance with the provisions of the Village Law.B. Not less than one Commissioner shall be a member of the Board of Trustees.C. Notwithstanding the provisions of the Village Law, two of the Commissioners may reside within the County of Nassau, New York, even though such residence is outside the corporate limits of the Village, if such person has either:(1) previously served on the Commission for at least 10 years; or(2) has at least 15 years of service as a police officer.îìß 30-4. †Terms; compensation.A. The terms of office of two of the Commissioner shall be for five years, and those Commissioners, at least one of whom shall be a member of the Board of Trustees, shall serve without compensation.B. The term of office of the other Commissioner shall be for a term of two years and shall be compensated as determined from time to time by the Board of Trustees.îSection 2. †Effective date. †This local law shall take effect immediately.Dated: †Kings Point, New York
