LEGAL NOTICE VILLAGE OF KINGS POINT NOTICE IS HEREBY GIVEN that a meeting will be held by the Board of Appeals of the Village of Kings Point at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, on August 5, 2024, at 7 00 p.m. The Board will immediately adjourn for advice of counsel and, at 7 30 p.m., the Board will commence public hearings for the consideration of the following application and such other matters as may come before the Board CASE NO. PRBZA20240316 – The application of Melody Lavian and Mehrdad Lavian, as owners, with regard to the premises at 30 Martin Court, Kings Point, New York, for variances from the following sections of the Code of the Village of Kings Point, for alterations and additions to an existing legal preexisting nonconforming single-family dwelling, a deck expansion, and a new pool and patio 1. §161-30.1(A) to permit a floor area of 15,409 square feet (an additional 1,657 square feet to the legal preexisting nonconforming 13,752 square feet), instead of the maximum permitted 8,619.08 square feet. [Legal preexisting nonconforming 60%, proposed nonconforming 79%] 2. §161-10(A) to permit a front yard setback of 74.3 feet (existing), instead of the required front yard of 119.3 feet. [Legal preexisting nonconforming 31.7 feet, proposed nonconforming an additional 13.3 feet because of the additional floor area.] 3. §161-30.4(A) to permit a roof height of 34.79 feet, instead of the maximum 28 feet for a flat roof. [Legal preexisting nonconforming 33.5 feet.] 4. §161-30.4(B)(1)(c) to permit an invasion into a rear yard skyplane by a height of 29.12 feet, instead of the maximum permitted 20.20 feet. 5. §161-30.2 to permit a building area of 9,649.08 square feet, instead of the maximum permitted 8,619.08 square feet (a variance of 12%). 6. §161-30.3(A) to not provide the required Belgian block or other masonry pavers for the 20 feet of the impervious surface closest of the edge of the paved portion of the roadway adjoining the front yard. The premises are shown on the Nassau County Land and Tax Map as Section 1, Block 150, Lot 26, and are located in a Residence A2 zoning district of the Village of Kings Point. The application and accompanying exhibits are on file in the office of the Village Administrator and may be inspected during normal business hours. At said hearing, all parties in interest will be given an opportunity to be heard.
