The Board of Trustees of the Village of Kings Point will hold a public hearing at 6:00 p.m., on Thursday, January 19, 2022, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bill 27 of 2022, which reads, as follows:1. Bill 27 of 2022, a local law amending the Code of the Village of Kings Point to authorize the appointment of alternate members to various Village boards.Be it enacted by the Board of Trustees of the Village of Kings PointSection 1. § 137-1, Continuation of Planning Board; powers and duties of Article I, General Provisions, of Chapter 137, Subdivision of Land, is amended to read as follows:ì§ 137-1. Continuation of Planning Board; powers and duties.A. The Planning Board heretofore established shall be continued and shall have all of the powers and duties provided by the Village Law, the General Municipal Law and the Nassau County Charter (Chapter 879 of the Laws of 1936, as amended) and any other general or special statutes, ordinances, rules or regulations, now or hereafter in force.B. The Board of Trustees may appoint not more than three residents of the Village as alternate members of the Planning Board. (1) The terms of office of each of said members shall be two official years. If an appointment is made during an official year, such term shall end at the end of the following official year. (2) The chairperson of the Planning Board may designate an alternate member to substitute for a member when such member is unable to attend a meeting or to participate in an application because of a conflict of interest or otherwise.(3) When so designated, the alternate member shall possess all the powers and responsibilities of such member.(4) Such designation shall be entered into the minutes of the initial meeting at which the substitution is made.îTo the extent that § 137-1 will now differ from subsection 16, Alternate members, of Village Law § 7-718, it is the intent of this legislation to supersede that subsection.Section 2. § 161-52, Architectural and preliminary site review board created, of Article IX, Architectural and Preliminary Site Review Board, of Chapter 161, Zoning, is amended by adding a new subsection E, to read as follows:ìE. The Board of Trustees may appoint not more than three residents of the Village as alternate members of the ARB. (1) The terms of office of each of said members shall be two official years. If an appointment is made during an official year, such term shall end at the end of the following official year. (2) The chairperson of the ARB may designate an alternate member to substitute for a member when such member is unable to attend a meeting or to participate in an application because of a conflict of interest or otherwise.(3) When so designated, the alternate member shall possess all the powers and responsibilities of such member.(4) Such designation shall be entered into the minutes of the initial meeting at which the substitution is made.îSection 3. § 161-63, Appointment; membership; terms; rules, of Article X, Board of Appeals, of Chapter 161, Zoning, is amended to read as follows:§ 161-63. Appointment; membership; terms; rules.A. A Board of Appeals shall be appointed by the Board of Trustees of the Village of Kings Point pursuant to the Village Law of the State of New York. Said Board shall consist of five members. They shall be appointed for the terms provided in said Village Law. Said Board shall make rules as to the manner of filing appeals or applications for variances from the terms of this chapter.B. The Board of Trustees may appoint not more than three residents of the Village as alternate members of the Board of Appeals. (1) The terms of office of each of said members shall be two official years. If an appointment is made during an official year, such term shall end at the end of the following official year. (2) The chairperson of the Board of Appeals may designate an alternate member to substitute for a member when such member is unable to attend a meeting or to participate in an application because of a conflict of interest or otherwise.(3) When so designated, the alternate member shall possess all the powers and responsibilities of such member.(4) Such designation shall be entered into the minutes of the initial meeting at which the substitution is made.îTo the extent that § 161-63 will now differ from subsection 11, Alternate members, of Village Law § 7-712, it is the intent of this legislation to supersede that subsection.Section 4. Effective date. This local law shall take effect immediately.
